This is the last Will and Testament of me Mary Serjeant of Netherbury in the county of Dorset made and published this 19th day of June 1833.
First I will and direct that all my just debts, funeral and testamentary expenses, and the expenses of proving this my will be paid and satisfied by my Trustees and Executor, hereinafter named, and I direct my said Trustees to give directions respecting my funeral and see that I am decently buried according to the instructions which I may leave for that purpose.

I further direct that my property next undermentioned be sold together and in one lot for the use of Hanna Denziloe. That is to say the house I now live in, the two dwellings which I bought of Loveless, all the orchard which I bought of Clift of Powerstock (the house being already sold), the field which I bought of Polly Whetham my niece, my Carriage House, Wringhouse and Stable together with any House or Buildings which I might hereafter erect or build at the corner of Shiers or upon any part of such my property before mentioned.
Also I give unto the said Richard Kiddle all such money so may be due unto me upon any security or securities whatsoever and wheresoever at the time of my decease and all my household goods, furniture, implements of household, plate, linen book sets and all and every my property of every sort and kind whatsoever and wheresoever for all my estate and interest therein (except my wearing apparel, my gold watch and certain articles of China hereinafter by me bequeathed).
My will is and I do hereby authorise and empower him, the said Richard Kiddle, immediately call in and retrieve[?] all such money as may be due to me as aforesaid and to sell and dispose of all my household goods, furniture and implements of household and all other my property of every sort and kind (except my gold watch and all other articles hereinafter excepted) as soon as conveniently may be after my decease. Out of the monies arising therefore as well as out of the monies arising from the sale of my said CopyholdType of feudal land tenure

In the first part to retain and pay unto himself the sum of £30 which legacy I hereby bequeath unto him, the said Richard Kiddle, for his own absolute use and benefit as a small recouperation for his kindness in consenting to under take the trusts of this my will.
In the next place to pay into the hands of Henry Denziloe of Bridport in the county of Dorset, Grocer, the sum of £3000 to remain in his possession at interest of £5 per centum per annum upon his note of hand and the interest thereof amounting to £15 per annum I direct is to be paid to my niece Polly the wife of John Denziloe of Bridport aforesaid Merchant for her life for her own sole and separate use by equal quarterly payments provided ???
My will is and I do hereby order and direct that as I was arrested[?] for the sum of £75 and obliged to pay the same for or on account of the said John Denziloe, the husband of the said Polly Denziloe, the said Interest or Annuity of £15 per annum shall abate and not be paid unto the said Polly Denziloe for the space of five years from the time of my decease unless the said John Denziloe or some person or persons on his behalf shall in the mean time so pay unto my said trustee the said sum of £75.
That the said Interest or Annuity of £15 shall for the said space of five years be paid into the hands of my said nephew Stephen Whetham of Bridport aforesaid and remain in his hands until Anna Denziloe, daughter of the said John and Polly Denziloe, shall attain the age of twenty one years or be married upon either of which events happening the same is to be paid by the said Stephen Whetham unto her the said Anna Denziloe it being my will that the said Polly Denziloe shall not receive any part of the said Interest or Annuity of £15 until the full amount of the said sum of £75 has been repaid to my Estate.
From and after the decease of the said Polly Denziloe then I will and direct that he my said trustee shall call in and receive payment of the said principal sum of £300 from the said Henry Denziloe and shall pay and divide that sum as follows viz: Unto the said Anna Denziloe the sum of £150, unto Edwin Denziloe, son of that John Denziloe the elder, the sum of £50 and unto John Denziloe the younger, another son of the said John Denziloe the elder, the remaining sum of £100.
I give and bequeath the following legacies that is to say unto the said John Denziloe the elder the sum of 1 shilling, unto the said Henry Denziloe the sum of 19 guineas, unto Matthew Denziloe, another son of the said John Denziloe the younger, the sum of £50, unto Mary Kiddle, daughter of the said Richard Kiddle, the sum of £5, unto William Warr, the son of Joseph Warr deceased who formerly kept the George Inn at Bridport, the sum of £5, unto each[?] of Mr Henry Symes his Daughters of Melplaish the sum of £5, unto my nephew, the said Stephen Whetham, the sum of £5, unto Charles Whetham, son of the said Stephen Whetham, the sum of £5, unto Daniel Treveat of Melplaish the sum of £2, and unto William Stone, son of Mount, the sum of £1.
All which said last mentioned legacies I direct to be respectively paid as soon as conveniently may be after the calling in and sale of my property before mentioned.
Also I give unto old Hannah Gale of Netherbury aforesaid 3d a week which I direct to be paid to her by my trustees weekly and every week during her life. Also it is my will that the sum of £55 be placed in the hands of the said Stephen Whetham, or Henry or Matthew Denziloe, at 4.5% interest and that out of the same the sum of £10 be paid annually unto the said Edwin Denziloe for the space of five years and the sum of £5 to the Granddaughter of Susanna Marsh of Netherbury aforesaid, Daughter of James Newbury, upon attaining the age of twenty one years. Also I give unto my niece the said Polly Denziloe and to the said Anna her daughter all my wearing apparel be equally divided between them. Unto the said Anna Denziloe I give my Gold watch also all my China Tea and Dinner Plates (except one perfect set of Tea China which is to be sold) and it is my wish that the said Gold watch be never sold but always remain in the family.
I direct my said Trustee to invest in the Government Stocks or funds the sum of £200 the dividends whereof I give and direct to be paid as follows. One moiety thereof annually to the Officiating Minister for the time being of Waytown Chapel within the parish of Netherbury aforesaid. The other moiety thereof annually to the Officiating Minister for the time being of the Chapel called Dr Roberts Chapel within the parish of Netherbury aforesaid. I desire that an amount of the said donations may be painted in legible English characters with black letters on a white ground on the front Gallery of each Chapel as soon as conveniently may be after my internment and I request that the same amount may be continued in good preservation in each of the said Chapels provided.
My will further is that in case the said John Denziloe, the older, or any person or persons claiming or to claim through him or his assigns shall dispute or attempt to dispute respecting the Boundary or the Ground which I claim round my house that I built and now live in, which said Ground that I claim is thirty nine feet from the stone in the West Bank to the North hedge in the lane[?] straight down the Garden from the West Bank half a foot below the Grape Vine in the South wall that I planted against the house then[?] I hereby revoke the aforesaid bequest of the said Interest or Annuity of £15 unto the said Polly Denziloe for her life and do direct that immediately after such dispute or attempt to dispute as aforesaid the payment of the said Interest or Annuity to the said Polly Denziloe shall absolutely cease and determine all the Rest Residue and Remainder of my Estate and Effects which I may be possessed of (after the several payments aforesaid) I hereby give to the said Anna Denziloe for her own sole and absolute use and benefit and so direct my said Trustee to pay and transfer the same to her accordingly.
I make constitute and appoint the said Richard Kiddle sole Executor to this my Will In Trust too the purposes aforesaid hereby revoking all former wills, surrenders and nominations by me at any time heretofore made and declaring this and no other to be my last will and testament.
I will and direct that my said Trustee his Executors and Advisors shall and may pay ??? to and reimburse himself and themselves all such costs charges damages and expenses as he or they shall or may be put unto in or about the Execution of the trusts of this my will and that he and they shall not be answerable or accountable for any more money than shall actually count[?] his or their hand or hands nor for any loss or losses which might happen to the said trust money or estate except that same shall happen through his or their own wilful default or negligence.
In Witness whereof I the said Mary Serjeant the testatrix have hereunto set my hand and seal the day and year first above written Mary Serjeant (£ S[?]) Signed sealed nominated published and declared by the said Mary Serjeant the testatrix as and for this last will and testament the same being contained on this and the proceeding five sheets of paper / in the presence of us who at her request in her presence and in the presence of each other have here unto subscribed our names as witnesses Charles Legg George Holland John Maber.
Whereas I Mary Serjeant did duly make and publish my last will and testament in writing bearing date the 19th day of June 1833 now I do hereby declare this present writing to be a codicil to my said will and do direct that it be annexed thereto and taken as part thereof.
Whereas by my said will I did give a certain portion of my property (which I directed to be sold in one lot) unto and for the use of Anna Denziloe and it is my wish and I do hereby direct that the proceeds of the sale of the said property after deducting the expenses attending the sale thereof be paid to the said Anna Denziloe for her own absolute use and benefit whether I shall leave sufficient property and effects to pay in full the legacies in my said will by me bequeathed to the respective legatees or otherwise.
In case the said property cannot be so sold in one lot for a sum which the Trustee of my said will shall consider to be its full value then I hereby order and direct him to convey and surrender the same property unto her, the said Anna Denziloe, and her assigns for ever on condition that she, the said Anna Denziloe, resides during her life nine months in every year in the parish of Netherbury.
Whereas by my said will I did also give the dividends or interest of the sum of £100 annually unto the Officiating Minister for the time being of Dr Roberts Chapel now I do by this my said codicil revoke the said bequest and instead do hereby direct the said Dividends or Interest of the said sum of £100 to be annually applied in the purchase of bread to be distributed amongst and given to certain poor persons in the parish of Netherbury.
Provided I shall leave sufficient property and effects to pay all the legacies in my said will respectively mentioned it being my wish and desire that my said Trustee do first pay all the said legacies before he shall pay and appropriate as well the sum of £100 or the dividends thereof in my said will by me bequeathed to the Officiating Minister for the time being of Waytown Chapel or any part thereof as the said sum of £100 or the dividends or interest thereof by this my codicil bequeathed to be applied in the purchase of bread as aforesaid or any part thereof.

In the goods of Mary Serjeant late of Netherbury in the County of Dorset deceased
Appeared Personally Shering Kiddle of Bridport in the county of Dorset Gentleman and Mary Kiddle of Netherbury in the same county Spinster and respectively made oath.
First the said Shering Kiddle for himself made oath that he is the writer of the paper writing hereto annexed purporting to be and contain the last will and testament of deceased bearing date the 19th day of June 1833 and that having most carefully viewed and inspected the same and observed the words “oath of” written on an erasure in the sixth line the words “the Grandson of” interlined between the twenty first and twenty second lines and the word “Granddaughter” struck through in the twenty second line of the fourth sheet of the said will counting from the top thereof he saith that the said words on the erasure and the interlineation[?] and obliteration aforesaid were made by him this ??? previous to the execution of the said will by the deceased.
The said Mary Kiddle for herself made oath that she knew @ were well acquainted with said deceased and that having now carefully viewed and inspected the paper writing also hereto annexed purporting to be a codicil to the aforesaid will of deceased the said codicil beginning thus “Whereas I Mary Serjeant did duly make and publish my last will and testament bearing date the 19th day of June 1833” and ending thus “In witness whereof I the said Mary Serjeant have hereto set my hand this 6th day of July 1833” she saith that she was present together with John Maber the subscribed witness thereto on the said 6th day of July and did then see the deceased execute the said codicil by putting her mark thereto in manner as now appears thereon.
Shering Kiddle Mary Kiddle on the 23rd day of September 1833 the said Shering Kiddle and Mary Kiddle were duly sworn to the truth hereof by virtue of the annexed commission before me Robt Broadley Rector of Bridport Dorset Commissioner
Proved at London with a codicil 27 Sept 1833 before the judge by the oath of Richard Kiddle the sole executor to whom Admon was granted having been first sworn by commission duly to administer.

Whereas I Mary Serjeant did duly make and publish my last will and testament in writing bearing date the nineteenth day of June 1833 now I do hereby declare this present writing to be a codicil to my said will and do direct that it be annexed thereto and taken as part thereof and whereas by my said will I did give a certain portion of my property /which I directed to be sold in one lot/ unto and for the use of Anna Denziloe and it is my wish and I do hereby direct that the proceeds of the sale of the said property after deducting the expenses attending the sale thereof be paid to the said Anna Denziloe for her own absolute use and benefit whether I shall leave sufficient property and effects to pay in full the legacies in my said will by me bequeathed to the respective legatees or otherwise and in case the said property cannot be so sold in one lot for a sum which the Trustee of my said will shall consider to be its full value then I hereby order and direct him to convey and surrender the same property unto her the said Anna Denziloe and her assigns for ever on condition that she the said Anna Denziloe resides during her life nine months in every year in the parish of Netherbury and whereas by my said will I did also give the dividends or interest of the sum of one hundred pounds annually unto the Officiating Minister for the time being of Dr Roberts Chapel now I do by this my said codicil revoke the said bequest and instead do hereby direct the said Dividends or Interest of the said sum of one hundred pounds to be annually applied in the purchase of bread to be distributed amongst and given to certain poor persons in the parish of Netherbury provided I shall leave sufficient property and effects to pay all the legacies in my said will respectively mentioned it being my wish and desire that my said Trustee do first pay all the said legacies before he shall pay and appropriate as well the sum of one hundred pounds or the dividends thereof in my said will by me bequeathed to the Officiating Minister for the time being of Waytown Chapel or any part thereof as the said sum of one hundred pounds or the dividends or interest thereof by this my codicil bequeathed to be applied in the purchase of bread as aforesaid or any part thereof In witness of I the said Mary Serjeant have here unto set my hand this sixth day of July one thousand eight hundred and thirty three

In the goods of Mary Serjeant late of Netherbury in the County of Dorset deceased
Appeared Personally Shering Kiddle of Bridport in the county of Dorset Gentleman and Mary Kiddle of Netherbury in the same county Spinster and respectively made oath and first the said Shering Kiddle for himself made oath that he is the writer of the paper writing hereto annexed purporting to be and contain the last will and testament of deceased bearing date the nineteenth day of June one thousand eight hundred and thirty three and that having most carefully viewed and inspected the same and observed the words “oath of” written on an erasure in the sixth line the words “the Grandson of” interlined between the twenty first and twenty second lines and the word “Granddaughter” struck through in the twenty second line of the fourth sheet of the said will counting from the top thereof he saith that the said words on the erasure and the interlineation[?] and obliteration aforesaid were made by him this ??? previous to the execution of the said will by the deceased and the said Mary Kiddle for herself made oath that she knew @ were well acquainted with said deceased and that having now carefully viewed and inspected the paper writing also hereto annexed purporting to be a codicil to the aforesaid will of deceased the said codicil beginning thus “Whereas I Mary Serjeant did duly make and publish my last will and testament bearing date the nineteenth day of June 1833” and ending thus “In witness whereof I the said Mary Serjeant have hereto set my hand this sixth day of July one thousand eight hundred and thirty three” she saith that she was present together with John Maber the subscribed witness thereto on the said sixth day of July and did then see the deceased execute the said codicil by putting her mark thereto in manner as now appears thereon Shering Kiddle Mary Kiddle on the twenty third day of September 1833the said Shering Kiddle and Mary Kiddle were duly sworn to the truth hereof by virtue of the annexed commission before me Robt Broadley Rector of Bridport Dorset Commissioner
Proved at London with a codicil 27 Sept 1833 before the judge by the oath of Richard Kiddle the sole executor to whom Admon was granted having been first sworn by commission duly to administer
